Please note the following terms and conditions are applicable to our learn to swim school only and are separate to the terms and conditions of the club.

- General
1.1. In these terms and conditions, ‘you’ means the swim school member (or the parent, guardian or caregiver where relevant), and ‘we’, ‘us’ or ‘our’ means Healthglo.
1.2. These terms and conditions apply to Healthglo Fitness and Leisure’s swim school programmes. By enrolling for lessons, you accept these terms and conditions.
1.3. Healthglo’s learn to swim program runs year-round for each school term. Private Lessons are negotiated with the instructor if they are run through each school holiday period.
1.4. The learn to swim program is available as two options:
(a) Group learn to swim is available as an 8-week group program commencing the second week of each school term
(b) Private learn to swim is available as a 10-week program for family groups of no more than 3 children each school term.
- Enrolment and Payment
2.1. There are 4 swimming terms per calendar year in line with published school terms.
2.2. Mid Term enrolments are welcome subject to availability. Pro rata fees will be charged based on the number of weeks remaining of term.
2.3. During end of term, enrolment rollover will occur, and your child’s booking will be carried over to the following term. Term enrolment is confirmed when full payment is received PRIOR to the new term commencing or a weekly payment option is accepted otherwise the term booking will be forfeited.
2.4. Lessons are not scheduled on Public Holidays and are not include in term fees.
2.5. Notification of term cancellations must be received 2 weeks PRIOR to term commencing or you will be invoiced for the full term of fees.
2.6. The swim school will apply fees associated with the enrolled activities offered at Healthglo and issue a term invoice as part of the listeed fees and charges. These fees are subject to review.
2.7. Lessons are payable upfront prior to the commencement of the swim term or lessons can be paid by Direct debit- fortnightly on a Friday or as an upfront payment on the day of the lesson. All direct debit details must be provided in full at the time of booking. A discount applies to a full-term payment.
2.8. Online payments can be made through your Healthglo portal accessible from our website.
2.9. A Waitlist is available. Customers will be removed from the waitlist:
(a) After an offer has been declined
(b) customers will be removed from the waitlist after 3 months
2.10. Holiday programme exceptions
(a) Paid in full – the lessons for the holiday period are paid for in full at the time of booking
2.11. Should you take a break from lessons for a term, your preferred lesson day/time may not be available when you choose to resume.
2.12. Any invoice not paid out by end of term will incur a $15.00 administrative charge per month until paid in full. We appreciate you understanding and prompt payment.
- Direct debits
3.1. Direct debits may be administered by us or by a third party appointed by us. We will provide you with access to the member portal to complete when you enrol. The direct debit facility will be used for payment of all fees and amounts owed by you as they become due.
3.2. If a direct debit cannot be processed (e.g., because of insufficient funds or changes to your bank account), we or our agent will charge an administration fee.
3.3. If you cancel the direct debit facility, or a direct debit cannot be processed for two successive payment dates, we may terminate your enrolment by providing you with written notice of termination.
3.4. After two missed payments we may suspend your enrolment until a payment plan is in place. To end any suspension due to non-payment of fees, you must pay all amounts owing plus any applicable administration fees.
3.5. In the event your enrolment is terminated due to a non-payment of fees, your account may be sent to a debt collection agency for recovery. Any recovery costs will be added to your outstanding account balance that is payable to the agency.
3.6. You are required to submit the completed direct debit forms and any associated forms at the time of enrolment.
3.7. Direct debits are processed on a Friday. However, if the Friday is a public holiday, the payment may be taken out of your account on the next working day.
- Cancellations
4.1. If we cancel a swimming lesson, then a credit to the value of that lesson will be applied to your next direct debit payment.
4.2. You can cancel your enrolment by giving us 10 business days’ notice in writing.
4.2.1. You must give notice of your intent to cancel:
(a) in person to reception completing a cancellation request form;
(b) via email to enquiries@healthglo.com.au;
(c) by phoning reception
4.3. If you have booked in for the term, and the term has begun, and do not wish to continue you will be charged for the entire term.
4.4. Should you fail to notify us in writing of your cancellation request prior to term commencement, full payment for the term will be required.
4.5. Unless a term booking cancellation is notified by the methods of clause 4.2.1, it will be assumed that you are continuing with lessons of the next term.
4.6. Cancellations will not be processed until any outstanding amounts owing are paid in full.
- Refunds or credits
5.1. Refunds are not available should you wish to cancel mid-term. Any outstanding term fees are deemed payable as set out in these terms and conditions.
5.2. In the event of a mid-term cancellation, refunds cannot be given for unused fees.
In exceptional circumstances when a refund is given, a $30.00 administration fee will be charged.
5.3. No refunds for mid-term cancellations on unused fees for a change of mind.
5.4. There is no refund or credit for missed lessons.
5.5. Refunds or credits can be granted in exceptional circumstances such as in the event of injury/illness, where 5 or more consecutive classes will be missed, a medical certificate must be supplied before the credit can be arranged. Once a credit has been issued, the child will lose their place and must re-enrol when ready to re-commence. Places cannot be held.
5.6. There are no administrative fees to process medical suspension credits.
- Absences
6.1. If you cannot make it to the learn to swim lesson, you must provide a minimum of 12 hours’ notice. If there are 2 or more consecutive absences without notification, forfeiture of the booking may occur, the child will lose their place and must re-enrol when ready to re-commence. Places cannot be held.
6.2. Due to operational costs associated with the swim school, there is no refund or credit for missed lessons. A family swim pass may be issued for missed lessons where the required notice of 12 hours has been provided.
6.3. Do not send children to lessons if they are unwell.
- Unscheduled Lessons
7.1. An offer is available for unscheduled lessons dependent upon instructor availability between Monday to Friday
7.2. The offer is subject to lesson availability/capacity in classes.
7.3. The standard conditions apply as above for unscheduled lessons/classes.
7.4. If you cannot make it to the learn to swim lesson, you must provide a minimum of 12 hours’ notice otherwise an invoice will be issued for the missed lesson.
- Data collection and privacy
8.1. You must provide us with correct contact information and always keep that information up to date (name, phone number(s), postal address, email address, emergency contact, authorised child pickup details).
8.2. All personal information that we collect about you will be held by us in accordance with the Personal Information Protection Act 2004 and our privacy policy. We will only use that information for purposes required for the operation of the swim school, including administration of your account, and for marketing purposes.
8.3. We will take all reasonable precautions to protect your privacy. You have the right to access and request correction of any personal information we hold about you at any time.
- Photography and recording of swimming lessons
9.1. We may take general photographs or videos of the facilities at any time. If you or your child appear in those photographs or videos, you agree that we may use them for marketing and promotional purposes and that you have no rights or copyright in the material. You release Healthglo, the photographer or filmmaker, and each of their licensees and assignees, from all claims and demands in connection with the material or its future use.
9.2. You must get the permission of the swimming teacher in charge of the lesson or the person in charge before taking photos or videos of anyone other than your own children.
9.3. Filming of lessons are strictly not permitted.
- Pool rules and hygiene
10.1. You must follow all facility rules and all instructions from our staff.
10.2. Please shower before entering the pool.
10.3. Swim caps are to be always worn during swimming lessons by children over three years old.
10.4. Swimmer nappies must be worn by all children under the age of three years.
10.5. Appropriate swimwear must be always worn. In the interest of public health and safety the following is required:
• 0–4-year-old and non-toilet trained children MUST wear waterproof aqua pants during lessons.
• Huggies (or similar disposable) swim pants must have an aqua pant over the top.
• Board shorts must have a tight fitted swimming brief underneath. No underwear.
• All swimwear to be made of lycra and nylon and to be always worn in the water.
• Saggy, loose-fitting garments will not be permitted in lessons.
• All children’s swim attire to be tight fitting. No underwear, nappies, boxer shorts or cotton outerwear permitted in the water.
• If you do not have the appropriate swim wear you will be asked to leave the water or swimming lesson.
- Parental Supervision policy
11.1. Healthglo Swim School participants under the age of 10 must be accompanied by a responsible person over the age of 16 years and Healthglo Fitness & Leisure reserves the right to refuse entry to any person, including Healthglo Swim School participants.
11.2. Participants in our programs may attend the facility without a responsible person in the following circumstances:
• Once the class has finished it is expected that the child leaves the premise
• Should children choose to partake in additional recreational activities outside of the dedicated training session a parent or guardian is required to be present
11.3. Healthglo Swim School participants under the age of 4 years will not be accepted by their instructor into lessons without their parent or guardian present.
11.4. Healthglo Swim School students must be dropped off to a Healthglo instructor and collected from a Healthglo instructor by a parent or guardian at the start and conclusion of every lesson.
11.5. Parents and guardians must remain easily contactable to the Healthglo instructor throughout the lesson to assist with any issues which may arise in the duration of the lesson.
11.6. Failure to adhere to Healthglo supervision policies may result in the termination of lessons.
- Other
12.1 In case of an emergency event, you must follow the directions of Healthglo staff.
12.2. All participants are expected to adhere to the club rules. This can be found on the Healthglo website.
12.3. If your child is waiting for your lesson to commence, all children must wait on the side of the pool and to consider other lessons in progress.
12.4. Access to the pool will be denied for the duration of a lesson when faecal or vomit contamination has occurred. No credits or refunds will be offered in this circumstance.
12.5. We reserve the right to change our fees at any time. We will give you 7 days’ prior notice (either by post or email or by publication at the Centre or on our website). If you are not happy with the change in fees, you may cancel your enrolment at any time before the change in fees takes effect. If you terminate your enrolment under this clause, we will not charge you an administration fee
12.6. Please make sure you have notified us of any learning or additional needs as well as any further information that may help us in teaching you or your child to swim.
12.7. Please be aware that we may make changes to the timetable. Where this is affects you and your lessons, we will give you reasonable advance notice.
12.8. By enrolling your child/children in our learn to swim programs you consent for child/children to use the centre’s equipment and facilities at your sole and absolute risk and responsibility in all things.
12.9. Credit for missed lessons will only be approved if the appropriate criteria are met with the required documentation.
12.10. The swim teachers and timetables are subject to change.
12.11. The above terms and conditions will apply until further notice. Any changes will be notified in writing.
12.12. We may terminate your enrolment immediately if you materially breach any of these terms and conditions. You are not entitled to a refund in that case. We also reserve the right to terminate your enrolment by providing you with at least 7 days written notice, in which case we will refund you any fees paid for any period after the date of termination.
